FAQ 2 - How do I search by dates?

The 'To' date is not inclusive when undertaking an advanced search by 'Search by Date Type'.

Example

If you want to search for notices published on 30 June 2018, you need to enter 30 June 2018 in the 'From' box and 1 July 2018 in the 'To' box. Entering 30 June 2018 in both boxes will result in no results being displayed.

FAQ 4 - Winding up Applications (withdrawn/dismissed)

The website is a register for certain notices published in accordance with the Corporations Act 2001, including winding up applications.

We maintain the website as an historical record of the notices published in accordance with Corporations Regulation 5.6.75.

Please note that there is no requirement under the Corporations Act 2001 or the Corporations Regulations for any party to lodge and/or publish on the website a notice of dismissal or withdrawal of a winding up application.

Accordingly, while the proceeding cited in the notice of winding up application on the website may no longer be current, it will remain on the website and is searchable as an historical record; much in the same way as for newspaper advertisements prior to the introduction of the website on 1 July 2012.

You can search ASIC's corporate register using the "ASIC Connect" facility on ASIC's website to see if the petitioning creditor has subsequently lodged a Form 519 to record the withdrawal or dismissal of the original application.

The notices published on ASIC's publication website are available to members of the general public. Some third party websites use the information from the publication website in their business operations. You will need to deal directly with those third parties if you are dissatisfied with their use of the published information.

FAQ 5 - Notices of Intention to Deregister - what happens when deregistration does not occur?

The website is a register for certain notices published in accordance with the Corporations Act 2001, including notices by ASIC of its intention to deregister a company. On some occasions, ASIC does not proceed to deregister a company the subject of a notice of intention to deregister.

There is no requirement under the Corporations Act 2001 to publish on any website a subsequent notice where ASIC does not proceed to deregister a company.

ASIC maintains the website as an historical record.

So, while the intention to deregister may no longer be current, the notice will remain on the website and be searchable as an historical record; much in the same way as for advertisements appearing in the Commonwealth Government Gazette prior to the introduction of the website on 1 July 2012.

To check whether a company was deregistered after publication of a notice of intention to deregister on the website, search ASIC's registers using the "ASIC Connect" facility on ASIC's website. Please note that ASIC cannot deregister a company until two months have passed from the publication of the notice on the website.

The notices published on ASIC's publication website are available to members of the general public. Some third party website use the information from the publication website in their business operations.
