Location: Due to Covid-19 and the resulting/potential Government policy on the restriction of social gatherings, this meeting will be held virtually only. i.e. there will be no physical location for the meeting.

Agenda

Agenda items are:

  • to receive and consider a report from the external administrator(s)
  • to consider a summary of the receipts and payments of the external administrator(s)
  • to fix or determine the remuneration of the external administrator(s)
  • to fix or determine the future remuneration of the external administrator(s)
  • to consider the early destruction of books and records
  • any other business

    • 1. to receive the report by the Administrator about the business, property, affairs and financial circumstances of the Company.
    2. to receive a statement of Administrator opinion and reasons for the opinion:
    a. whether it would be in the creditors' interest for the Company to execute a deed of company arrangement;
    b. whether it would be in the creditors' interest for the administration to end;
    c. whether it would be in the creditors' interest for the Company to be wound up.
    3. to receive a statement of such other information known to the Administrator as will enable the creditors to make an informed decision about the matters at paragraphs 2(a)- (c).
    4. to receive details of any transactions that appear to the Administrator to be a voidable transaction in respect of which money, property or other benefits may be recoverable by a liquidator under part 5.7B of the Act.
    5. to receive details of the proposed deed of company arrangement.
    6. for the creditors of the Company to resolve that:
    a. the Company executes a deed of company arrangement;
    b. the administration should end; or
    c. the Company be wound up.
    7. to consider the appointment of an alternative deed administrator and or liquidator.
    8. to determine the deed administrator and or liquidator future remuneration if appointed
    9. if the Company is wound up, to consider the appointment of a committee of inspection and, if so, who are to be the committee members.
    10. if the Company is wound up then to consider the early destruction of books and records.
    11. to determine the future disbursements of the administrator.
    12. to determine the liquidator's future disbursements
