"That pursuant to Section 477(2B) of the Corporations Act 2001, the Liquidator be authorised to enter into a funding agreement with Claims Funding Australia Pty Ltd atf the Claims Funding Australia Discretionary Trust, to enable the prosecution of the claim against Scottish Pacific (BFS) Pty Limited (formerly named Bibby Financial Services Australia Pty Limited)"
- To consider and if thought fit, approve the following resolution:
"That pursuant to Section 477(2B) of the Corporations Act 2001, the Liquidator be authorised to enter into an agreement with the Commonwealth of Australia under the Fair Entitlements Guarantee (FEG) Recovery Program for the provision of indemnity support to the Liquidator for any adverse cost orders made during the proposed proceedings against Scottish Pacific (BFS) Pty Limited (formerly named Bibby Financial Services Australia Pty Limited)"
