NOTICE OF MEETING OF CREDITORS

Notice is given that a meeting of the creditors of the Company, or a meeting for each of the Companies, (for multiple companies), will be held:

Agenda

Agenda items are:

  • to receive and consider a report from the external administrator(s)
  • any other business
  • 2. To consider and vote on the following motions:

    a. That Clause 13.8(d) of the Deed be amended to read as follows:

    The Deed Administrators must adjudicate whether to admit a Claim by a Non-Continuing Employee Creditors by no later than 23 June 2020

    b. That Clause 13.8(e) of the Deed be amended to read as follows:

    The Deed Administrators must adjudicate whether to admit a Claim made by a Creditor (other than a Non-Continuing Employee Creditors) not later than 30 days after the adjudication date for non-continuing employee claims

    c. That Clause 14.3(a)(i) of the Deed be amended to read as follows:

    on or before 30 June 2020, make a distribution to the Non- Continuing Employee Creditors and Priority Creditors in respect of Admitted Claims of Non-Continuing Employee Creditors (Initial Priority Creditor Distribution)

    d. That Clause 14.3(a)(ii) of the Deed be amended to read as follows:

    on or before 31 July 2020, make a distribution to Unsecured Creditors in respect of all Admitted Claims of Unsecured Creditors at that date (Initial Participating Creditor Distribution)

    Proof of debt and proxies

    Creditors wishing to attend are advised proofs and proxies are to be submitted to the external administrator by:

    Special instructions

    Due to the threat of COVID-19, and consistent with government policy on gatherings, a virtual meeting will be held. Creditors are expected to attend by electronic means, and no physical place of meeting is provided.Creditors must provide contact details so they may be contacted if they do not respond when the Deed Administrator confirms proofs of debts and proxies at the start of the meeting.

    iii. a method by which the person, proxy or attorney may be contacted for the purposes of the meeting.
