ASIC Published Notices

Notice is given that a meeting of the creditors of the Company, or a meeting for each of the Companies, (for multiple companies), will be held:

Agenda items are:

1. to receive and consider a report from the liquidator(s)
2. to fix or determine the remuneration of the liquidator(s)
3. to fix or determine the future remuneration of the liquidator(s)
4. to appoint a committee of inspection and, if so, who are to be the committee members
5. any other business

6. To authorise the Liquidator to compromise debts owed to the Company, for the purposes of section 477(2A) of the Corporations Act 2001; and
7. To authorise the Liquidator to enter into agreements, including litigation funding agreements, for the purposes of Section 477 (2B) of the Corporations Act 2001.

Creditors wishing to participate in the meeting by telephone must return to the convenor of the meeting not later than the second last working day before the day of the meeting, a written statement setting out the name of the person and of the proxy or attorney, (if any), an address to which notices to the person, proxy or attorney may be sent, a telephone number at which the person, proxy or attorney may be contacted and any facsimile number to which notices to the person, proxy or attorney may be sent. A person, or the proxy or attorney of a person who participates in the meeting by telephone, must pay any costs incurred in participating and is not entitled to be reimbursed for those costs from the assets of the Company.
