Agenda

Agenda items are:

  • to receive and consider a report from the external administrator(s)
  • to consider a summary of the receipts and payments of the external administrator(s)
  • to fix or determine the remuneration of the external administrator(s)
  • to fix or determine the future remuneration of the external administrator(s)
  • to appoint a committee of inspection and, if so, who are to be the committee members
  • to remove the external administor(s) from office and appoint someone else as external administrator(s) of the company
  • to consider the early destruction of books and records
  • any other business

    • 1. to receive the report by the Administrators about the business, property, affairs and financial circumstances
    of the Company;
    2. to receive a statement of Administrators opinion and reasons for the opinion:
    a. whether it would be in the creditors' interest for the Company to execute a deed of company arrangement;
    b. whether it would be in the creditors' interest for the administration to end;
    c. whether it would be in the creditors' interest for the Company to be wound up.
    3. to receive a statement of such other information known to the Administrators as will enable the creditors to
    make an informed decision about the matters at paragraphs 2(a)- (c);
    4. to receive details of the proposed deed of company arrangement;
    5. for the creditors of the Company to resolve that:
    a. the Company executes a deed of company arrangement;
    b. the administration should end; or
    c. the Company be wound up.
    6. if the Company is wound up, determine the liquidator of the Company;
    7. to determine the future disbursements of the administrators; and
    8. to determine the liquidator's future disbursements.

    Proof of debt and proxies

    Creditors wishing to attend are advised proofs and proxies are to be submitted to the external administrator by:

    Special instructions

    Creditors can attend virtually via Microsoft Teams platform.

    To attend and participate in the meeting, please submit or email the completed Proof of Debt or Claim form and Proxy form to Joshua Beckett of my office (joshua.beckett@westburnadvisory.com.au) by no later than 13 June 2024 by 5:00 pm to facilitate checking and recording.

    Once my office receives a completed proof of debt form and proxy form, you will receive a Microsoft Teams link via email to register for meeting access (Meeting ID and Password).
