ASIC Published Notices

Notice is given that a resumed meeting of the creditors of the Company, or a resumed meeting for each of the Companies, (for multiple companies), will be held:

Agenda items are:

1. To seek further approval of the Joint and Several Administrators remuneration;

2. To seek further approval of the Joint and Several Administrators internal disbursements;

3. The Purpose of the adjourned meeting is to determine the fate of the Company, specifically if:

a. the Company executes a Deed of Company Arrangement;
b. the Administration ends; or
c. the Company be wound up;

4. In the event the Company executes a Deed of Company Arrangement, confirm the appointment of Peter Gountzos, Richard John Cauchi and Timothy James Brace as the Joint and Several Deed Administrators of the Company;

5. To seek approval of the Joint and Several Deed Administrators remuneration;

6. To seek approval of the Joint and Several Deed Administrators internal disbursements;

7. In the event that the Company is wound up, confirm the appointment of Peter Gountzos, Richard John Cauchi and Timothy James Brace as the Joint and Several Liquidators of the Company;

8. To seek the approval of the Joint and Several Liquidators remuneration;

9. To seek approval of the Joint and Several Liquidators internal disbursements;

10. In the event that the Company is put into Liquidation, authorise the Liquidators to destroy, at their discretion, the books and records of the Company within six months after dissolution of the Company, subject to obtaining prior approval from the Australian Securities and Investments Commission.

11. To appoint a Committee of Inspection; and

12. Any other business which may be properly brought before the meeting.
